The Public Procurement Note 01/21, published Feb 2021 allows direct award of contracts where the following have been met and documented: * Genuine reason for extreme urgency - in this case, increased referrals resulting from Covid19 and usual recruitment avenues not being successful * The events leading to the urgency were unforeseeable - in this case, Covid19 * It is impossible to comply with the usual timescales (i.e. run a tender) - in this case, the Trust required social workers urgently in order to meet statutory responsibilities. * The situation is not attributable to the contracting authority - in this case Covid19 was unforeseeable and despite best efforts, the Trust have not been able to recruit to these positions"
