The supply of the majority of spares required for the overhaul are protected by Intellectual Property Rights of Plasser. This award is permitted under Regulation 50 c (iii) the protection of exclusive rights, including intellectual property rights. It is not economically viable or operationally feasible for the Contracting Authority to disaggregate these elements to carry out elements of the overhaul separately, in order to tender services not covered by the protection of IPR, as this would not offer overall value for money to the taxpayer due to the additional operational and commercial costs involved of two separate requirements."
