Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(i) of the Defence and Security Public Contracts Regulations 2011) - Absence of tenders or suitable tenders. The NSPLW natures were originally advertised via the competition DGM/1965 as Lot 2 and Lot 3. However, due to an absence of tenders or suitable tenders, the Authority now intends to obtain these natures from the only tenderer for these lots under DGM/1965, EPA Manufacturing Limited, via a single source contract under the non-competitive negotiated procedure.
