This regulation allows the Council to award a contract without prior publication \"insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures cannot be complied with\". The urgency in this case results from the forthcoming end of the Council's contract with Fusion on short notice, with the result that a full procurement cannot be undertaken at this time without a potential delay in continued provision of leisure services. The Council is developing a longer-term strategy for the management of the leisure services and will be carrying out a procurement exercise to engage a permanent provider in due course. A market testing session will be arranged as part of the future procurement and will be advertised via Contracts Finder and Find a Tender Service for providers to express an interest."
