In the event that the Council does award routes that do result in a Framework Service Provider operating more than 25% of the available routes, the Council reserves the right, at its discretion, to apply such financial and other assurance checks as it considers to be reasonable, provided that such additional checks are agreed with the Framework Services Provider before the award of the relevant route(s). 3.3. Mini-competition When a requirement has been identified by the Council, all Framework Providers on the Open Framework (in the relevant Lots) will receive a mini-competition route specification (see Schedule 5 within the Education Transport Framework Agreement) issued via email. This will contain all the requirements and specific details, including if a Passenger Assistant is required, for the Framework Providers to respond to within the specified time frame. Once the submission deadline has passed, bids will be evaluated on the basis of 95% price and 5% quality. Quality will be assessed based on the provider's response to the mini-competition route specification. Once a suitable Framework Provider has been identified as a result of the mini competition, a call-off contract (see Schedule 7 within the Education Transport Framework Agreement) will be issued. 3.4. Direct Award The Council reserves the right to contact a single Framework Provider, or a specified selection of Framework Providers and to make a Direct Award in the following circumstances: a. Where there has been no appropriate offer received. b. Where the Services are needed urgently/immediately (within 48 hours) c. When the Services are needed out of core office hours (5pm-9am overnight, Weekends or Bank Holidays). d. Where the Services are needed when a Tribunal or appeal process is in progress. e. Where the Services required are out of the county. f. When the Council wants to add a service user to an existing route. In the event of a direct award pursuant to paragraphs A, B, C, D, and E, any routes so awarded shall be for a maximum duration of one school term. Upon expiry of this period, such routes shall be subject to re-tendering through a formal mini-competition process.
