    "description": "Whilst Section IV.1.1 (Type of procedure) in this Notice indicates this was an Open process this is incorrect but cannot be amended. The circumstances relate to the modification of a negotiated contract which was originally valued at less than GBP 50k and as such, at that time, it was not a regulated contract. If HIE were to allow time to undertake an Open tender for the additional work it would significantly impact on the overall project. Therefore, HIE consider Regulation 6b (ii) of The Procurement (Scotland) Regulations 2016 (relating to situations when contracts can be awarded without competition) provide justification for this modification. In addition, if there were a change in supplier this would cause significant inconvenience and/or substantial duplication of costs to HIE. The value stated in II.1.7 relates to the full contract period i.e. 1st December 2020 to 30th September 2021. (SC Ref:658444)",
