Foreman The Contractor shall provide an appropriately qualified and experienced foreman to manage the Contractors' (and sub-contractors) activities, workload and to liaise with the Employer on matters affecting the contract and works generally. The role of the foreman is to ensure continuity of workload and high levels of communication and co-ordination between the Council and Contractor. The Contractor must ensure that adequate cover is provided at all times and that workflow is managed and monitored effectively to ensure the Contractors performance is maintained at a high level. The Contractor shall allow for the provision of foreman activities within the tendered rates. Person-In-Charge During working hours the Contractor is to keep on the various works a competent person in charge, who shall be empowered to receive and act upon any instructions given by the Contract Administrator or his representative. The Person in Charge may be the Contractors' foreman where appropriate, or may be another employee working on the site. Where the person in charge is not the Contractors main foreman the Contractor must ensure that the appointed individual is capable of managing works to the satisfaction of the Contract Administrator. Plant, Tools and Vehicles Provide all tools, tool sharpening, hoisting, tackle, ladders, tarpaulins, plant, vehicles, fuel etc. for the proper execution of the works, including securing necessary permissions for use, all requisite labour, cartage and maintenance during the progress of the works and allow for making the same available for the use of all trades and for removing on completion. All plant required for the execution of works specified in the Schedule of Rates (and subsequently agreed rates) shall be deemed to be included in the Contractors' price. Works carried out on a dayworks basis shall use the RICS Schedule of Basic Plant Charges for Use in a Building Contract (latest edition) to determine the appropriate charge out rate for all necessary equipment. Any items of plant used but which do not appear in the RICS Schedule shall be charged at a rate agreed between the parties, and shall typically be based on similar items appearing on the RICS Schedule. Payment for Plant and Equipment shall normally be based on the actual period of use of the equipment, not the period spent on-site.",
