The grounds for awarding contract without a prior call for competition are that: (1) Competition is absent for technical reasons (The Edinburgh Science exhibition already exists; No other potential tenderer could create an exhibition from scratch in the required timescale; The additional costs for another potential tenderer to create a new exhibition from scratch do not represent value for money). (2) No other supplier could provide the Edinburgh Science exhibition to Zero Waste Scotland, due to the Edinburgh Science Foundation's ownership of IPR in relation to the exhibition. (3) The circumstances (that no reasonable alternative or substitute exists and the absence of competition) have not arisen because of an artificial narrowing of the procurement parameters for the project on behalf of Zero Waste Scotland.",
