A formal tendering process would take several weeks, which is not feasible under these circumstances. The use of a negotiated procedure without prior publication is therefore justified on the following grounds Under Regulation 33(1)(c) of the Public Contracts (Scotland) Regulations 2015: a. Urgency: Immediate action is required to protect the health and safety of vulnerable residents. b. Unforeseeable Event: The bed bug infestation was unforeseen and beyond the control of the housing scheme management. c. Inability to Use Standard Procedures: The time required to conduct a competitive tendering process (e.g., open or restricted procedures) would significantly delay the provision of essential pest control services, thereby endangering the residents. Failure to act swiftly could lead to: a. Worsening of the infestation, increasing treatment complexity and costs. b. Potential harm to residents' health and well-being, including legal liabilities if the housing scheme is found negligent in addressing the issue. c. Negative publicity and damage to the reputation of the Group.",
