In accordance with: 'The Public Contracts (Scotland) Regulations 2015, SSI 2015/446 1 91(7)(a)' , this will be published to protect NHSGGC against the risk of an ineffectiveness challenge to the lawful direct award of a contract. Additionally and in line with the practices of: Fairness; Openness and Transparency; the publication of this VEAT Notice has been balanced against the risk that publication of this VEAT Notice may, in fact, increase awareness of the proposed direct award and increase the risk of challenge. A VEAT was the best legal procurement route to take because the disruption as a result of installing a new system would be significant and would have wide reaching consequences impacting: Staff; Patients and Services in addition a heightened risk of delivering this requirement in line with Scottish Government imposed timescales. The contract will be in place until the 31/05/2025.",

NHS Greater Glasgow and Clyde believe it is the only organisation able to demonstrate manufacturer qualified staff, in all of the required disciplines and systems, with access to the required software engineering tools and support, and in-depth knowledge of the building and current controls installation. Consequently awarding to another supplier would cost a significant amount money and disruption to NHSGGC Staff and Patients. Therefore the best course of action to insure compliance with procurement regulations, and ensure the installation building energy controls is provide by the timescales stated ,is to publish a voluntary ex ante transparency (VEAT) notice.",
