The Facility provides a critical waste disposal function for all of these council areas. It serves around 227,000 homes and approximately 6,500 businesses. It enables the Councils to discharge their statutory duties under the Environmental Protection Act 1990. The defenders have also expended very substantial sums in constructing the Facility. They have a clear and obvious interest in ensuring that it is properly preserved and maintained. There is otherwise a very real risk that public funds will be wasted.
