## Notice

Contract Modification (under PCR 2015 Regulation 72). Supply of Personal Protective Equipment for Healthcare Workers for the Care of Patients with Suspected or Confirmed Novel Coronavirus (COVID19). In March 2020, The Department of Health and Social Care [the 'Authority'] awarded a contract for the supply of Personal Protective Equipment (hand sanitisers) to protect Health and Care Workers from contracting COVID19 disease. For reference, this Modification Notice relates to Procurement reference: CF-0031100D0O000000rwimUAA2. DHSC has issued Modification as follows: A)December 2020: There was an extreme shortage of private storage facilities within the UK, due to EU Exit and expiry of the transition period under the Withdrawal Agreement which was 31st December 2020. At the time, the possibility that a no deal may occur led to a saturation of the storage facilities available within the UK. As a result, DHSC was unable to locate alternative private storage facilities onshore. Therefore: a. A contract pause variation was implemented for December 2020 till February 2021, which enabled enough time for DHSC to obtain emergency storage facilities. b. An initial contract extension was issued for 1st March 2021 till 30th June 2021. Allowing the supplier to manufacture and deliver the Goods. B)January 2021: The original contract value of $21,354,000.00 was increased by $10,800.00 for payment of replacement of "expired packaging with manufacturing date of Sep. 2020". Total contract value: $21,364,800.00. C)Time only Contract Extension implemented for 01.07.2021 - 30.09.2021. Permitted under the safe harbour in Regulation 72(1)(c) as the supplier informed DHSC, and DHSC accepts, that it has encountered issues in obtaining ingredients for the manufacture of the Goods, arising from the pandemic and other external issues out of its control, which is delaying it delivering the Goods. Permitted under The Public Contract Regulations 2015 Regulation 72 (1) (c), all the following conditions are fulfilled: (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii)the increase in price does not exceed 50% of the value of the original contract.
