## Summary

The procurement process conducted by ESPO, a major Central Purchasing Body situated in Leicester, pertains to the establishment of a national framework titled "615_25 Street Furniture". This framework aims to supply various types of urban furniture such as benches, bins, shelters, and cycle racks, across all regions of the UK. The procurement method used is an open procedure (above threshold) with the tender stage already completed. The total estimated value of this framework is £32,000,000, with the contract period extending from 1st February 2025 to 31st January 2027. The deadline for the tender applications was on 7th November 2024.

This tender provides substantial opportunities for businesses specialising in urban furniture and outdoor equipment, particularly SMEs and voluntary organisations. With ESPO monitoring suppliers' financial stability throughout the framework period, reliable and financially stable companies are likely to benefit the most. The framework agreement spans multiple urban furniture items divided into lots, making it suitable for a variety of suppliers focusing on specific products like benches, bins, shelters, or cycle racks. Being part of such a framework can help drive business growth by providing consistent demand from public bodies across the UK, creating long-term relationships and securing significant contracts.

ESPO has established a commercial trading company, ESPO Trading Limited, whose target clients are third sector organisations such as national and local charities, public sector mutual organisations and other organisations involved in the delivery of services to or for the public sector. The successful Supplier may be asked to enter into an additional separate framework agreement (the Second Framework) with ESPO Trading Limited on materially similar terms to that found in the tender pack to be entered into by ESPO itself. Any Second Framework agreement will be a purely commercial agreement and will, for the avoidance of doubt, not be governed by the Public Contract Regulations 2015 or other public procurement legislation. ESPO Trading Limited may enter into the second framework agreement with the successful supplier and make it available to third sector clients who themselves are not required to follow the Public Contracts Regulations 2015 or other public procurement legislation. Accordingly, this is provided for bidders information only. An eAuction process may be used to award subsequent call off contracts following the reopening of competition among the parties to the Framework Agreement.
