## Summary

The Department for Environment, Food & Rural Affairs (Defra) has completed the procurement process titled "pEPR - Statutory Appointment of a PRO - Legal Advice," classified under the industry category of legal advisory services. The procurement aimed to appoint an industry-led Producer Responsibility Organisation (PRO), with legal support required for the appointment processes. This selective procurement was executed through a call-off from a framework agreement. The contract, valued at £120,000, covers delivery to locations including the British Overseas Territories, Channel Islands, Europe, and the UK. The award was announced on 18th September 2025, with the contract period running from 8th August 2025 to 31st March 2026.

This tender presents substantial opportunities for growth for firms specialising in legal advisory services, particularly those with expertise in environmental and regulatory compliance. Businesses with the capability to navigate complex legal frameworks and support statutory appointments will find this contract beneficial. The procurement process's rigorous and transparent nature underscores the demand for high-calibre legal professionals capable of delivering insightful legal advice. Potential bidders who can handle significant responsibilities within the public sector are well-suited to compete for similar opportunities with Defra and other governmental bodies requiring expert legal consultation services.

## Notice

To appoint an industry led PRO which will be delegated relevant functions by PackUK to support with ongoing delivery of the pEPR scheme. Legal support is required to assist with the appointment process of a PRO. There are four main phases to the work: * Prepare the proposed conditions of appointment * Prepare the appointment process * Run the appointment process and select the candidate PROs * Confirm conditions of appointment and appoint the PRO As PackUK and the 4 nations agree which functions are to be delegated to the PRO and in which years, these will in turn need to be set out in conditions of appointment. The greater the responsibilities delegated to the PRO, the more robust the appointment process will need to be, so legal support will be used to assist with the design, drafting of application documentation, and the subsequent assessment of applications. Given the possibility of multiple applications, Defra is working on the basis that a clear, transparent and rigorous assessment process is necessary for this work, and legal support will be utilised in the application assessments and finalising conditions of appointment. This contract will run for eight (8) months from August 2025 to March 2026.
