The Contract will be for 10 years fixed term with the option to extend for a further 5 years. The Concession Contracts Regulation 2016 (SI 2016/273) (CCR 2016) came into force on 18 April, 2016. Regulation 11 CCR 2016, provides that the regulations do not apply to concession contracts for the principal purpose of permitting contracting authorities to provide or exploit public communications networks, or to provide to the public one or more electronic communication services. However, RBKC intends to execute this procurement in a manner that respects the principles of equal treatment and transparency using an open procedure and has therefore chosen to apply the Light Touch Regime of the Public Contract Regulations 2015. There will be no selection/shortlisting stage. The Authority has, however, identified a number of Minimum Requirements relating to technical and professional ability and experience, and economic and financial standing that it believes are necessary for tenderers to meet.
