## Notice

NHS England South (South East) seeks to commission an integrated substance misuse treatment service for HMP High Down, HMP Downview, HMP Coldingley, HMP Send and a Psychosocial Intervention SMS service to Gatwick IRC. Scope of establishments; HMP High Down (male category B/C prison) - Clinical and psychosocial SMS. HMP Coldingley (male category C prison) - Clinical and psychosocial SMS. HMP Downview (female closed prison) - Clinical and psychosocial SMS. HMP Send (female closed prison) - Clinical and psychosocial SMS. Gatwick IRC (immigration removal centres - Brook House and Tinsley House) - Psychosocial interventions only. This service will provide specialist support for all those assessed as requiring interventions to address drug or alcohol misuse within the above mentioned HMPs and Gatwick IRC. It is commissioned as part of the overall Offender Health pathway within the prison and as such the model will ensure an integrated, recovery orientated treatment system both within the prison and referral into the community or another custodial setting. The service will focus on delivering a seamless, integrated structured clinical and psychosocial substance misuse interventions/services in prison and through the gate into the community to ensure effective continuity of care. Close joint working with other services is imperative to the success of the delivery in this service. The substance misuse service is to be made available to drug and/or alcohol misusers including poly-drug misusers and include dual diagnosis clients. The successful provider must meet the unique needs of the establishment and take into account the needs of the population within that establishment, Bidders must be aware that, although this procurement is undertaken in good faith, potential government policy changes could enact changes to prison healthcare provision. Bidders/providers must be prepared to work with commissioners to implement any nationally mandated directives, whether during the procurement or the ensuing contract. The Services are healthcare services within the meaning and scope of Annex XIV of Directive 2014/24/EU("the Directive") and Schedule 3 to the Public Contract Regulations 2015 ("the Regulations"). The tendering process will be conducted in accordance with the requirements and flexibilities provided by Articles 74 to 76 of the Directive, and Regulations 74 to 76 of the Regulations. The Authority will run a transparent tender process, treating all bidders equally. For the avoidance of doubt, the Authority will not be bound by the Regulations or the Treaty on the Functioning of the European Union or any other regulations or legislation except for the specific arts or circumstances that apply to the procurement of these Services. Neither the inclusion of a bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule3of the Regulations. The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations74 to 77).
