Our position, after reviewing the advice from counsel, is that under the unforeseen current global public health crisis there is a strong argument that the direct award of a contract with Kuehne & Nagel Ltd is compliant with current PCR regulations in respect to section 32(2)(c). Additionally Kuehne & Nagel Ltd are the only supplier which can facilitate the importation of the product which is a permissible direct award reason under RM6074 Lot 8, and is also compliant under PCR section 32(2)(b)(ii).
