### Procurement Information

Army HQ Commercial Branch, part of the UK Ministry of Defence, intends to award a contract to VIASAT UK Limited formerly known as 'Horsebridge Defence & Security'. for the purchase of additional VIASAT UK Limited secure Communications equipment as soon as possible. It is considered that this Contract can be placed using the negotiated procedure without prior publication of a Contract notice pursuant to Article 28(3)(a) of Directive 2009/81/EC and Regulation 16(1)(b)(i) of the Defence and Security Public Contract Regulations 2011 as the equipment is required in addition to an existing installation of existing goods. To obtain goods from another Supplier other than VIASAT UK Limited would oblige the MOD to acquire goods having different technical characteristics. VIASAT UK Limited provide a closed security system which requires HS secure communication equipment. In addition to providing the secure system and equipment, VIASAT UK Limited provide the support and maintenance for both. Any other supplier's equipment would be incompatible with the system and existing equipment, as they would not be able to link their equipment to the current VIASAT UK Limited equipment and systems. If such a link was attempted this would lead to disproportionate technical difficulties in both operation and maintenance.
