Under Regulation 33 (1) (b) (ii) of the Public Contracts (Scotland) Regulations 2015, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons-- (ii) competition is absent for technical reasons; Explanation The equipment is required for a follow on study on asthma attacks over 12 months. The results of this study must be comparable with the original study which used the same equipment. The equipment incorporates a shorter test setting for younger children. The Niox products are protected by a number of patents in the US, Europe and a range of other countries.
