Thus because the supplier in this case has exclusive rights to the only potential area for social housing development, as per clause 33.1.bii where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement, an award is being made without a prior publication
