### Procurement Information

This framework is not an award without prior notice. The Framework Agreement was awarded as set out in Find a Tender Notice 2021/S 000-024584 published on 29/11/2021 was entered into by EANI as per the published Contract Award Notice 2022/S 000-004869 published on 21/02/2024. (Framework Agreement). The Framework Agreement was initially for a value of PS570,000. This proposed modification value will increase the overall value of the framework to PS855,000 GBP and does not exceed 50% of the value of the original contract. The modification is permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled: (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; Initial values were based upon historical spend however due to the ad hoc nature of this framework, and the increased incidents involving EA fleet, expenditure has been larger than previous projections. Modification to the framework is necessary to ensure ongoing service provision. The release of this additional spend for these services could not have been foreseen at time of tender and therefore not included in the original estimated Framework Agreement value. The framework is a demand led agreement, and the Authority could not have reasonable foreseen the increase on demand for these services. This service provision fluctuates significantly from month to month. (ii) The modification does not alter the overall nature of the framework; and (iii) Any increase in price does not exceed 50% of the value of the original contract or framework agreement. The awarded value of the original Framework Agreement was PS570,000 GBP. This modification of PS285,000 represents 50% of the original contract value.
