The Supplier is required to supply labour and materials to overhaul the bottom (main) conveyor on 44 x MFS Wagons in batches of 10 at the supplier's location. The Supplier is required to supply and fit OEM components. The Supplier is required to carry out the repair to the hardox shafts in accordance to the Plasser's documented process.

### Procurement Information

The requirement to repair the hardox shaft as part of this requirement is a repair procedure protected by Intellectual Property Rights of Plasser. The supply of the majority of spares required for the overhaul are protected by Intellectual Property Rights of Plasser. This award is permitted under Regulation 50 c (iii) the protection of exclusive rights, including intellectual property rights. It is not economically viable or operationally feasible for the Contracting Authority to disaggregate these elements to carry out elements of the overhaul separately, in order to tender services not covered by the protection of IPR, as this would not offer overall value for money to the taxpayer due to the additional operational and commercial costs involved of two separate requirements.
