## Summary

The Ministry of Defence, specifically the Naval Ships Support division, is seeking to award a contract titled "Naval Classification Services." This procurement falls within the services industry, specifically dealing with the repair and maintenance services of ships, and is based in Bristol, UK (region UKK11). The procurement method employed is a limited approach through a negotiated process without publication of a contract notice, and it is currently in the award stage. The contract is initially set for two years, with a potential total value of approximately £11,980,000, which includes three optional one-year extensions valued between £2,400,000 and £2,500,000 each, depending on the necessity as determined by the Authority. The contract was signed on 18 October 2021.

This contract presents significant growth opportunities for businesses that specialise in naval classification and maritime services. Companies that are well-versed with Lloyd's Register Naval Ship Rules and have the capability to provide classification surveys, inspections, and related services will be particularly well-suited to compete. The involvement of Lloyd's Register EMEA as the awarded supplier underscores the specific technical requirements and safety considerations inherent in this contract, thereby creating an opening for suppliers with relevant expertise and experience in naval compliance and certification services.

### Procurement Information

Naval Ships Support, part of the UK Ministry of Defence ("the Authority") intends to proceed to award a contract for the provision of Naval Classification Services to Lloyd's Register EMEA ("Lloyd's Register").The contract is for an initial period of 2 years with a value of approximately 4 580 000 GBP. Three further Option Years are included in the contract, which may be exercised, if desired by the Authority. The value of each of these Option Years is approximately PS2 4000 000 - PS2 500 000 GBP giving an overall estimated contract value of 11 980 000 GBP. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons. This is on the basis that the Lloyd's Register Naval Ship Rules (LRNSR) for the Classification of Ships and Naval Ships are extensive, complex and safety-critical. Only Lloyd's Register, the parent Classification Society of the LRNSR rule set can conduct surveys, plan appraisals and provide certification against any naval platforms which are classified as being "in-class" in accordance with the LRNSR. In operating and maintaining platforms in line with LRNSR, it is not possible for another Classification Society to provide equivalent certification against an alternative set of Naval Ship rules. Changing the rule set in respect of which the naval platforms are currently classified would introduce an unacceptable level of safety risk to the naval platforms and personnel. Lloyd's Register is the only Classification society, for these naval platforms, that have delegated authority from the DE&S Naval Authority Group for issuing Naval Ship Stability Certification on their behalf.
