## Summary

The UK Ministry of Defence (MOD), specifically the International Guns, Missiles and Rockets Project Team, is set to award a contract for "Phalanx Close In Weapons System In-Service Support." This procurement process is currently at the Award stage and has a total contract value of £39,500,000. The contract is aimed at providing Contracting for Availability services, commencing in February 2023, and will have a term of up to five years, including a three-year initial term and two optional years. The services will be delivered in the UK according to the Defence and Security Public Contracts Regulations 2011, under a limited procurement method, negotiated without publication of a contract notice.

This tender presents substantial opportunities for businesses in the defence sector, particularly for those with expertise in the maintenance and repair of advanced weapon systems. Companies that have specific technical capabilities and resources, similar to those of Devonport Royal Dockyard Limited (DRDL), which has been awarded the contract, may find it advantageous to engage in bidding for similar future opportunities. Given the specialised nature of the services required, businesses with existing experience in military technology and systems integration will be well-positioned to compete effectively in this domain.

### Procurement Information

The International Guns, Missiles and Rockets Project Team, part of the UK Ministry of Defence (MOD) intends to award a contract of up to five years (a three year initial term plus two option years) to Devonport Royal Dockyard Limited (DRDL) for Contracting for Availability services for the Phalanx - Close In Weapons Systems (CIWS) from February 2023 In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful under Regulation 16 (1) (a)(ii) of the Defence and Security Public Contracts Regulations 2011. This is for technical reasons because only DRDL have the specific know-how, tools and means needed to meet the MOD's In Service Support requirement concerning this complex military weapon system. In addition, DRDL are the sole licensed European operator of the Phalanx CIWS under a licensing agreement in place with Raytheon Missiles and Defence (RMD) who are the original equipment manufacturer.
