## Summary

The Ministry of Defence is undertaking a procurement process for the "Provision of BOWTIE Licences Support and Maintenance" specifically within the IT services category, focusing on software development and consulting. This procurement is currently at the award stage following a limited procedure without prior publication of a call for competition, primarily due to the technical nature of the requirements. The procurement involves the provision of additional user licences necessary for creating bowtie diagrams used by MOD personnel and is situated in Glasgow, UK. Notably, the contract for this procurement was signed on 1st October 2019, and the specific contractual need arose due to the necessity for uniform software usage across the organisation's air platforms.

This tender presents significant opportunities for businesses that specialise in IT services, particularly those with expertise in software development and maintenance. Companies capable of delivering similar software solutions or additional support services could benefit from this procurement, especially those familiar with the integration of safety-related data systems. Furthermore, firms with a track record in governmental or defence sector engagements would be well-positioned to compete, as the Ministry of Defence seeks to ensure consistency and avoid substantial duplication of costs across its operations.

### Lot Information

Lot 1

Procurement of additional licences with support and maintenance.

### Procurement Information

The Secretary of State for Defence intends to amend a current supply contract with CGE Risk Management Solutions B.V. for the purchase of additional user licences for use by MOD personnel to create "bowtie" diagrams which visualise complex safety information and transfer that information from Air DT safety staff to Aviation Duty Holders to support engineering processes which relate to equipment safety as part of the Authority's support of and maintenance to its air platforms. In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 32(b)(ii) of the PCR 2015 because competition is absent for technical reasons. The Authority needs to purchase these additional licences from the original contractor and cannot consider a change of contractor for technical reasons as all the Air DT staff need to use the same software to create uniform, similar bowtie diagrams across the Authority's air platforms and in addition, to do anything different would cause significant or substantial duplication of cost.
