The Department for Education's position in the High Needs Operational Guidance 2019 - 20 set out: The department's position is that the provision of special educational needs and alternative provision placements forms part of the system of public education which is financed, entirely or mainly, by public funds and supervised by local authorities. Consequently, securing such provision is to be considered as a non-economic activity, with the result that the agreement between a local authority and institution to make SEN provision required by an EHC plan is not regarded as a public service contract for the purposes of the Public Contracts Regulations 2015.
