## Summary

The Ministry of Defence is initiating the procurement process for the disposal of MK217 Mod 0 Payloads, classified under the category of weapons, ammunition and associated parts. This limited tender is currently in the Award stage, with an active contract awarded to Irvin GQ Ltd, valued at £94,834. The contract was signed on 14 December 2021, and delivery is set to occur in the UK, specifically in the region of Bristol (UKL17). This procurement follows regulations that allow negotiated contracts without prior publication due to the technological exclusivity of the supplier.

This tender presents a significant opportunity for businesses specialising in munitions decommissioning and related services, particularly those with unique technical capabilities or proprietary knowledge. As the supplier chosen for this contract has exclusive access to the required designs and components, companies in the defence sector that can demonstrate similar expertise and experience in handling complex disposal operations are well-suited to compete in such future tenders. Engaging in this area could foster business growth and establish a foothold in defence contracting opportunities.

### Procurement Information

The Secretary of State for Defence, acting by the Defence General Munitions Team (DGM PT), intends to enter into a contract with IrvinGQ Ltd (the Supplier) for the Payload Disposal. The estimated total value of the procurement is PS94,834.00 ex-VAT. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the DSPCR 2011 on the basis that for technical reasons as the original equipment manufacturer for the Payloads the Supplier alone has the technical designs, tools, parts, knowledge and know-how necessary to meet the requirements set out in the Contract.
