## Summary

The public procurement process is being conducted by the Ministry of Defence in Bristol, UK, for the provision, repair, and design services of spare parts related to fire detection and suppression, specifically for military aerospace equipment. The tender titled "SPARES PROVISION, REPAIR (SPARES INCLUSIVE) AND AD HOC POST DESIGN SERVICES (PDS) FOR FIRE DETECTION, FIRE SUPPRESSION, INFLATION AIRCRAFT EQUIPMENT AND NBC MANIFOLD ASSEMBLIES" is currently in the Award stage, with the contract signed on 25 June 2021 and covering a four-year period starting from 1 April 2022. The estimated contract value is approximately £6.715 million (including VAT), and the procurement method employed is limited, allowing this tender to be negotiated without prior publication of a contract notice.

This tender represents a significant opportunity for businesses specialised in the provision of military aerospace spare parts and related services, particularly those with expertise in fire-fighting equipment and aircraft systems. Companies that are well-suited to compete for this contract are likely those that are small-to-medium enterprises (SMEs), especially given the recognition of the contractor as an SME in previous amendments. Suppliers with the ability to quickly respond to technical demands and those who have a thorough understanding of the original design rights related to the equipment would find themselves in a competitive position.

### Procurement Information

The Air Commodities Delivery Team (ACDT), part of the UK Ministry of Defence (MoD), intends to place a new 4-year Contract with L'Hotellier for the provision of Spares, Repairs and Post Design Services (PDS) for aircraft fire-fighting equipment, life raft inflation equipment and inertia switches used aboard 15 different Royal Air Force (RAF) platforms. The estimated Contract start date is 1st April 2022 and the estimated Contract value is PS6.715M (Inc. VAT). In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations (DSPCR) 2011 for the technical reasons set out below. L'Hotellier possess the original design rights for the majority of the equipment, much of which is only supplied or licensed by L'Hotellier. L'Hotellier is the only company with the experience, product knowledge and historical data to undertake the PDS activities and it is not considered possible for another economic operator to become sufficiently qualified, within the necessary timeframe, to undertake PDS investigations and fault investigations without incurring an unacceptable level of risk. This would result in the Authority being unable to fulfil its safety obligations to ensure safe operation of the associated platforms and aircraft systems within an airworthy environment. To consider another supplier to meet this requirement would potentially create Aircraft on Ground (AOG) scenarios across the 15 aircraft platforms that rely upon this equipment.
