## Summary

The Cheshire East Borough Council is seeking providers for the "NHS Health Checks" programme, classified under health services, located in Cheshire East, United Kingdom. This tender process is classified as complete and is a statutory requirement under the Local Authorities (Public Health Functions) Regulations 2013. The procurement method used was a 'limited' approach, specifically a negotiated procedure without the publication of a contract notice, due to the unique access General Practitioners have to confidential medical data necessary for delivering these services. Contracts will be awarded to GP Practices across Cheshire East, with initial contract terms set for three years, plus options for two additional twelve-month extensions.

This tender presents significant opportunities for growth for healthcare providers, particularly General Practices and medical centres that can deliver NHS Health Checks. Given that these services require access to patient medical data and phlebotomy services, businesses that have the capacity to comply with the necessary regulatory frameworks and demonstrate the ability to provide the required health services will be well-positioned to compete. With a budget allocation of £40,000 per contract, eligible suppliers can take advantage of these funding opportunities to expand their service offerings within the healthcare sector.

## Notice

The NHS Health Check is a national prevention programme which aims to reduce the chance of a heart attack, stroke or developing certain forms of dementia in people aged 40-74. It achieves this by assessing the top seven risk factors driving the burden of non-communicable disease in England. It also provides individuals with behavioural support and where appropriate pharmacological treatment to address these risks. Commissioning of NHS Health Checks is a statutory requirement of Councils resulting from The Local Authorities (Public Health Functions and Entry to Premises by Local Healthwatch Representatives) Regulations 2013. GP Practices throughout the borough of Cheshire East will be awarded contracts for Delivery of NHS Health Checks (including identification of patient eligibility).

### Procurement Information

The Public Contract Regulations Section 32.(2).(b).(ii) states: 32.--(1) In the specific cases and circumstances laid down in this regulation, contracting authorities may award public contracts by a negotiated procedure without prior publication. General Grounds (2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons:-- (ii) competition is absent for technical reasons. In the context of this contract, General Practitioners are the only suitable supplier as they have sole access to the confidential medical data necessary to ascertain the invitations and commit to completing Health Checks for those eligible. General practices also have access to phlebotomy services that are required for the Cholesterol check. This is absorbed into their overall business costs. Whilst a 3rd party provider can use Point of Care Testing (POCT) equipment to undertake this check it is noted in recent research to not be as effective as a full blood test. This equipment is also expensive which would lead to additional service costs. Any alternative Provider would need to factor in costs in administrative tasks, the logistical impact on supplying health checks to service users and the need for a comprehensive GDPR risk assessment and information sharing agreement for a large number of eligible population. This does not represent best value to the Council.
