## Summary

The Ministry of Defence is undertaking a procurement process for the "Provision of Osseointegration Surgery", which falls under the category of surgical hospital services. This contract, valued at £1,120,000, was awarded to The Royal Orthopaedic Hospital NHS Foundation Trust and is intended for the treatment of MoD patients with combat-related injuries. The procurement method applied is limited, with the award procedure carried out without prior publication of a call for competition. This initiative is currently in the award stage, having been officially signed on 6 April 2022, with all services to be delivered in the UK.

This tender represents significant opportunities for businesses within the healthcare sector, specifically those capable of providing specialised surgical services and rehabilitation support. Companies with expertise in orthopaedic and plastic surgery, as well as providers who can offer comprehensive aftercare and rehabilitation services, would be particularly well-suited to compete for such contracts. Engaging in this procurement can not only help to expand service offerings but can also bolster relationships with governmental and military healthcare institutions.

### Procurement Information

The Authority placed a contract with Royal Orthopaedic Hospital Birmingham (ROH) for the provision of Osseointegration for MoD patients that have had combat related injuries. In accordance with the Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 (SI 2020/1319) this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015) is lawful on the basis that competition is absent for technical reasons. The Authority considers that ROH is the only Contractor that has the necessary NHS surgical team with the required experience, skills and expertise to undertake this procedure, which is not routinely commissioned within the NHS. The Authority also considers that the ROH is the only Contactor that has the required surgical capacity to undertake these procedures due to the Covid-19 backlog.
