## Summary

The Ministry of Defence, based in Bristol, UK, has awarded a contract worth £233,000 for the in-service support of 11 Caterpillar IT28 Rough Terrain Forklifts. This procurement, classified under the CPV code for all-terrain vehicles, follows a limited negotiation process without prior publication of a contract notice, as permitted by specific public procurement regulations. The award is part of a contractual extension, running for an initial 12 months with an option for a further 6 months, aimed at maintaining operational capabilities while navigating global supply chain challenges. The contract was signed on 20 April 2022, succeeding the current agreement which is set to expire on 5 May 2022.

This opportunity presents significant growth potential for businesses specialised in heavy equipment maintenance and support services. Companies with expertise in providing technical services for construction or military machinery would be particularly well-suited to compete, especially those familiar with the Ministry of Defence's procurement processes. Given the complexities and specific requirements involved, firms that can demonstrate a strong knowledge of MOD supply chains and have a proven track record of maintaining such specialised equipment could find this contract a valuable pathway to expand their operations in the public sector.

### Procurement Information

The Air Commodities Team, part of the UK Ministry of Defence ("the Authority") intends to extend the existing Contract ASCOMM5/1172 with Finning UK Limited for a period of 12 months, with further option period of 6 months at a total cost of up to PS233,000.00 The current Contract runs to 5th May 2022 and sustains the global availability of 5 Rough Terrain Forklifts Vehicles. It is considered that the contract can be extended using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 72(1)(b) of the Public Contracts Regulations 2015: It has been deemed necessary to extend the existing service for technical reasons in addition to the fact to compete the requirement at this time would cause significant disruption to the Rough Terrain Forklift capability. The extension to Contract ASCOMM5/1172 ensures a level of SQEP is maintained whilst requirements relating to a complex amalgamation of Contracts for a future competition are obtained. Considering timescales and the complexity, if the Contract were not be extended in this instance, it is likely a gap in technical knowledge and capability would jeopardise the safe operation of the fleet of vehicles and would cause significant inconvenience or substantial duplication of costs for the contracting Authority. Furthermore, Finning UK possess the knowledge of MOD supply chain processes specific to this requirement, which are vital in satisfying routine and mission critical spares demands in a timely manner, maintaining operational output during a time of global supply chain instability.
