### Lot Information

Lot 1

The Department currently owns 23 weather stations which have been purchased from Vaisala at various times. The Department requires continued management and maintenance for these stations from 1st October 2022 until such time as they are replaced.

### Procurement Information

The Department's 23 weather stations were all purchased from Vaisala. Since Vaisala are the original manufacturers of the various elements making up the various weather stations, only they can currently provide the management and maintenance that is required for these stations without considerable cost to the Department of replacing the stations or at least replacing many of the separate elements which go to make up a weather station. The Public Contracts Regulations 2015 - Regulation 32. (2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases: (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: (ii) competition is absent for technical reasons, (iii)the protection of exclusive rights, including intellectual property rights, but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
