The NHS Health Check programme aims to prevent heart disease, stroke, type 2 diabetes, kidney disease, and raise awareness of dementia and alcohol harm both across the population and within high risk and vulnerable groups within Derbyshire. In April 2013 the NHS Health Check became a statutory public health service in England. ### Procurement Information

There is currently no assured alternative way to systematically identify the eligible population and therefore ensure coverage to achieve the Council's mandate, due to the need to access the patients' record as Derbyshire GP's are not willing to share their data with other providers to undertake NHS Health Checks and therefore for technical reasons competition is absent. Obtaining data via NHS digital, only provides limited amounts of information and will limit outcomes and patient uptake due to the technical data constraints. Furthermore, this alternative would not achieve best value and also risk compromising the Council's duties under Reg 4(6) The Local Authorities Regulations 2013. Health Checks, Reg 4 (6) requires the Council "In discharging the requirement under paragraph (1), the local authority shall act with a view to securing continuous improvement in the percentage of eligible persons in its area participating in the health checks". There is no statutory requirement for private providers to give local Healthwatch any information or to respond to recommendations or comment which would risk compromising the Council's duties. Public Health Functions and Entry to Premises by Local Healthwatch Representatives) Regulations 2013. Part 4 Where can Enter & View take place? The legislation places a duty on health and social care providers to allow Authorised Representatives of Healthwatch to carry out an Enter and View visit on premises where health and social care is publicly funded and delivered: The list of service providers who have a duty to allow entry is set out in section 225 of the Local Government and Public Involvement in Health Act 2007 and supplemented by Reg 14 of the Public Health Functions and Entry to Premises by Local Healthwatch Representatives) Regulations 2013. The Council is required to provide Health Checks to eligible people in accordance with Regulations 4 and 5 of the Local Authorities Regulations 2013. These regulations specify the information to be recorded. The limitations and constraints regarding the data sharing issues, prevents third parties from being able to deliver NHS Health Checks across Derbyshire and prevents the Council from fulfilling its statutory duties as set out above and therefore for technical reasons competition is absent.
