## Summary

The Ministry of Defence, acting as the buyer, has recently awarded a contract to MBDA UK Ltd for the "Future Portfolio Assessment Phase - Initial Enablers" in the services category related to military defence services. The procurement method used was a limited award procedure without prior publication of a call for competition. The contract, worth £5,230,000, was signed on 28th July 2022. This tender presents an opportunity for businesses involved in military defence services to engage in innovative development projects with the Ministry of Defence. Companies with experience in the defence industry, particularly those specialised in the development, qualification, manufacture, and support of complex weapons, would be well-suited to compete for such contracts. The Ministry of Defence, by awarding this contract to MBDA UK Ltd, aims to enhance its operational advantage and freedom of action in the defence sector while ensuring the continuation of the UK's sovereign industrial base for complex weapons supply.

The Complex Weapons Future Portfolio Team within Defence Equipment & Support (DE&S), which is a part of the UK Ministry of Defence (the Authority), intends to place an 18 month Assessment Phase contract with MBDA UK Ltd to assess and de-risk the development and implementation of new acquisition approaches and methodologies in the development, qualification, manufacture and support of Complex Weapons. It is considered that this contract is exempt from the application of the DSPCR in accordance with Article 346(1)(b) of the TFEU (as it was launched prior to 31 December 2020), for reasons connected with the protection of essential security interests, namely the continuation of the UK's Operational Advantage and Freedom of Action.
