## Summary

The Torbay Council has recently awarded a contract for the provision of School Transport Bus Passes, overseen by the Children’s Services Transport Team. The procurement process, which was categorised under public road transport services, has reached the 'award' stage. The contract covers the whole of Torbay and is set to commence on 01 September 2022 for an initial 12-month term, with the possibility of extensions over the next 2 years. The buying organisation, Torbay Council, has identified a specific need for home-to-school transport services for Pupils and Students aged between 4 and 19, living in Torbay. The contract aims to provide school-to-home transport services and bus passes, catering to various travel needs within the region.

This tender provides an opportunity for businesses that specialise in public road transport services to engage in providing essential transport solutions within Torbay. With the contract details specifying the requirements for travel on all term days, frequent timetables, and accessible pickup and drop-off points, businesses with experience in school transportation services would be well-suited to compete. The Torbay Council has implemented a procurement method of 'limited' in this negotiated process without the publication of a contract notice, aiming to address the technical constraints that limit competition within this specific market segment. As the contract is geared towards meeting the transport needs of school children and students, businesses focusing on student transportation services could find this tender as a strategic growth opportunity aligning with their expertise and capabilities.

## Notice

The Children's Services Transport Team is responsible for providing a home-to-school transport service for Pupils and Students who live in Torbay who are aged between 4 and 19 and who are entitled to help to get to school or college. ### Procurement Information

There is an absence of competition for technical reasons because due to having only two local economic operators who provide bus transport and bus passes within the scope of our requirements, we are unable to undertake a competitive procurement process in line with the Directives. In the case of the wider Torbay provision, Stagecoach is the only operator able to cover the whole of Torbay at the times and locations required to provide an adequate choice of services to users within the required distance of their home. In the case of Brixham College, this service is already provided to college students who are not eligible for Council provided home-to-school transport and as the service they are providing is geared to meet the needs of students attending Brixham College, they are in a position to widen their offer to students eligible for home-to-school transport. The Authority has as yet not entered into new contracts with these suppliers and is advising the market that, subject to internal approval and the outcome of this VEAT process, is intending to do so. Torbay Council are intending to enter into this Contract on 01 September 2022 for an initial 12-month period with rolling 12-month possible extensions over a period of 2 years.
