As the supplier retains Intellectual Property Rights (IPR) this restricts the ability of another economic operator to provide the supplies and ensure the safe operation and maintenance of Ultra equipment on site. Additional information: The service provider retains the Intellectual Property Rights (IPR) relating to Regulation 32(2)(b)(iii) PCR (the protection of exclusive rights, including intellectual property rights), subject to accompanying legal advice. Regulation 32(2)(b)(ii) PCR (competition is absent for technical reasons) also applies. Regulation 32 (5) (b) of the Public Contract Regulations 2015 (PCR) also applies
