## Summary

The Ministry of Defence, Defence Equipment and Support, Type 31 Delivery Team has awarded a Framework Agreement for the Supply of Specialist Ammunition to NAMMO Raufoss AS. The tender, titled "Provision of Training Ammunition for Type 31 Naval Guns," falls under the main procurement category of goods and is classified under CPV code 35331200 for shells. The procurement method used was a limited negotiation without publication of a contract notice, and the award value is £11,000,000. The Agreement aims to provide qualified 40mm and 57mm practice ammunition for Bofors naval guns to support the Type 31 General Purpose Frigates.

This tender presents an opportunity for businesses specialising in military ammunition supply to engage in a framework agreement to provide specialist ammunition for naval guns. Companies with expertise in manufacturing and supplying training ammunition for naval applications, especially those familiar with the technical requirements of Bofors naval guns, would be well-suited to compete. The Ministry of Defence's decision to award this contract without prior publication of a contract notice was based on technical reasons, particularly the unique expertise and capabilities of NAMMO Raufoss AS in providing qualified TP ammunition for the specific naval gun systems required for the Type 31 Frigates.

### Procurement Information

Ship Acquisition, part of the UK Ministry of Defence ("the Authority"), intends to amend contract DGM/1910 -- Small Arms Ammunitions with NAMMO Raufoss AS, to include technical support and qualified TP (training) ammunition for the 57mm Mk3 and 40mm Mk4 naval gun systems that will be supplied with the five Type 31 General Purpose Frigates. This contract was the subject of a previous VEAT reference: OJEU Reference OJ/S S159 21/08/2018 365879-2018-EN. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for Technical Reasons. This is because NAMMO is the supplier of the TP ammunition that is currently being qualified by the ship builder and is the only economic operator with the necessary know-how, proprietary processes, and equipment-specific tooling and test equipment to ensure that the qualified T31 TP ammunition is safe to be utilised in the Type 31 naval gun systems at ship acceptance. NAMMO also owns the IPR for both the 57mm and 40 mm TP ammunition.
