Following a decision to not award a contract due there not being any suitable tenders in response to an open procedure Norfolk Council took the decision to use the negotiated procedure without prior publication in accordance with Regulation 32 (2). The Council entered into negotiations with Tilbury Douglas Construction Limited, Tilbury Douglas's score having been substantially higher than the next-placed bidder's in the abandoned open procedure. The negotiation under Regulation 32(2)(a) entailed no substantial alterations to the initial conditions of contract.
