It is considered that the procurement of the contract in the circumstances detailed in this Strategy Document is consistent with Regulation 33 (1) (b) (ii) of the Public Contracts (Scotland) Regulations 2015, which allows the contracting authority to award a public contract without prior publication of a contract notice or prior information notice when (ii) competition is absent for technical reasons but only, ...where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. Hamilton Sales and Service UK Limited is the sole supplier who can provide the required consumables.
