## Summary

Sport England recently completed a procurement process for Netsuite licensing, a financial system used to record transactions, make payments, and produce annual accounts. This procurement involved the award of licenses through an Award procedure without prior publication of a call for competition. The organisation's financial responsibility to regulatory bodies was a key driver for this procurement. The procurement was undertaken via a competitive procedure through GCloud 9, and Oracle Corporation UK Limited won the contract worth £557,000, signed on July 31, 2023.

The use of Netsuite provides opportunities for businesses in the accounting software industry, particularly those involved in tax preparation and financial analysis software. The competitive criteria for this tender included Technical Compatibility and Price, with a split of 50% each. Businesses with expertise in providing integrated financial systems and software packages would be well-suited to compete in similar tenders in the future. Given the complexity and specific requirements of the financial system, businesses with proven track records in delivering technical solutions within regulatory constraints would find this tender particularly relevant.

## Notice

Netsuite is required to enable the organisations to discharge its responsibilities, to DCMS and other regulatory bodies, to retain auditable records ensuring accounts are completed in accordance with financial reporting standards. Sport England tendered and procured the use of Oracle Netsuite as an integrated finance system through a competitive procedure conducted via GCloud 9 and licence renewals for the first four years were covered by the initial business case. A 2-year renewal of the existing system allows a sufficient window to complete a tendering exercise followed by an implementation and testing process to ensure the needs of the organisation can be achieved.

### Procurement Information

Sport England tendered and procured the use of Oracle Netsuite as an integrated finance system through a competitive procedure conducted via GCloud 9 and licence renewals for the first four years were covered by the initial business case. Netsuite licences are required to access the financial system to ensure that the recording of financial transactions, making payments, producing the annual accounts, and reporting to DCMS and Companies House. Netsuite, or other finance system, is required to enable the organisations to discharge its responsibilities, to DCMS and other regulatory bodies, to retain auditable records ensuring accounts are completed in accordance with financial reporting standards. The system is highly technical and there are specific interoperability requirements. Netsuite is an integrated financial system, which hosts 4 different companies for which accounts are prepared. There are complex relationships between these subsidiaries to ensure that not only the finances are recorded accurately but VAT, which is subject to partial exemption, is calculated correctly. No reasonable alternative or substitute currently exists. Any new implementation would have to be designed and tested to ensure that the integrity of the financial records between the subsidiaries are accurately maintained. A 2-year renewal of the existing system will allow a sufficient window to complete a tendering exercise followed by an implementation and testing process to ensure the needs of the organisation can be achieved. A tender exercise to identify and implement a replacement financial system, which underpins the financial integrity of the organisation will take a minimum of 18 months. A voluntary ex ante transparency notice was published in advance of the award, and the award was approved under the Department for Culture Media and Sport Spend Control process.
