There are derogations under the regulations to award a contract to a single supplier where the supplies or services can only be supplied by a particular supplier for the following reason:- i) in cases of extreme urgency brought about by events unforeseen or attributable to the contracting authority, where the time limits for the open, restricted or competitive procedures with negotiation cannot be compiled with (regulation 32(2)(c)). Due to unforeseen circumstances the Equality Commission will be without IT support from the end of March and it would not be possible to complete a competitive tender exercise given the timescales involved. This award is for a short term DAC (for a period of up to one year) to provide cover until a new service model can be established (either via internal NICS IT service provision or following a competitive tender exercise).
