## Summary

The Ministry of Defence (MOD) has entered into a services contract with C Data Services Ltd to maintain and support bespoke business system management software applications for the Royal Fleet Auxiliary (RFA). This contract, classified under technical support services, will commence on 1st December 2024 and run for a duration of 2 years, with an option to extend for one additional year. The contract's approximate value is £860k (excluding VAT). The procurement process was carried out under the Defence and Security Public Contracts Regulations 2011, and the contract was awarded without prior publication for technical reasons, as C Data Services Ltd are the sole holders of the necessary software code and technical expertise.

This tender creates opportunities for businesses specialising in bespoke software maintenance and system management, particularly those experienced in the defence sector. While the contract has been awarded to C Data Services Ltd, similar opportunities could arise as the defence sector continually requires such specialised support. Companies with expertise in technical support services and a portfolio of work with bespoke system management tools would be well-positioned to compete in future tenders of this nature. The focus on a single supplier also underscores the importance of exclusivity in technical knowledge and intellectual property in securing these contracts.

### Procurement Information

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 (DSPCR) as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the DSPCR for technical reasons. This is because the business system management software applications were developed for the MOD as bespoke applications by C Data Services Limited, which is the only supplier with access to the necessary software code and other technical data relating to the software applications and having the specialist know-how necessary to perform the services, which are required to enable the continuing operation of the business systems using these software applications.
