## Summary

The NHS Birmingham and Solihull Integrated Care Board has initiated the procurement process for the "Provision of Intermediate Minor Oral Surgery (IMOS) in Shrewsbury (PDS Contract)," classified under CPV code 85130000 (Dental practice and related services). The procurement, which falls under the services category, is aimed at providing Level 2 oral care for patients with procedural and/or patient complexities requiring clinicians with enhanced skills. The procurement stage is in the award phase, with the contract awarded to Visiting Specialist Services Limited with a total value of £2,089,745.20 for a 10-year term starting from 15th November 2024 to 14th November 2034, including an initial 7-year period valued at £1,462,821.64 and an optional extension of up to 3 years valued at £626,923.56. Key dates include the contract signing on 5th September 2024, and the service location is primarily Shrewsbury, within the UKG22 region.

This tender presents significant opportunities for businesses involved in dental practice and related healthcare services. Companies with expertise in Level 2 oral surgery and accredited clinicians would be well-suited to compete. The contract's substantial value and long duration provide financial stability and the potential for long-term partnerships with the NHS. Businesses with previous experience in similar healthcare services, especially those operating within the Shropshire and Staffordshire regions, would find this tender highly advantageous for growth. Additionally, it opens avenues for expanding service offerings and establishing a stronger presence in the healthcare sector. The procurement method involved a direct award procedure without prior publication, following unsuccessful attempts to secure providers through conventional competitive processes, highlighting the importance of timely and suitable service provision in this critical healthcare area.

### Procurement Information

The ICB have ran two separate IMOS procurements across Shropshire and Staffordshire in 2022 where there were 5 lots (Stoke, Stafford, Burton, Telford and Shrewsbury). During the first procurement the ICB failed to secure providers for Burton and Shrewsbury. The second procurement sought to secure providers for Burton and Shrewsbury but were only able to secure a provider for Burton. Since the first procurement, the Telford IMOS provider has been providing a wider IMOS service to cover patients from the Shrewsbury from their premises in Telford. Following the failure of the 2 procurements for Shrewsbury, the ICB ran a targeted expression of interest exercise (EoI) for Shrewsbury aimed at all successful Shropshire and Staffordshire IMOS bidders and those that didn't secure a contract but whose total procurement score was above the minimum qualifying threshold. Following the EoI process, one provider came forward, this being the provider for the Stoke and Stafford IMOS lots. The ICB has therefore concluded that Regulation 32 of The Public Contracts Regulations 2015 is applicable to this situation and wish to Direct Award the Contract to Visiting Specialist Services Limited. Use of the negotiated procedure without prior publication 32.-(1) In the specific cases and circumstances laid down in this regulation, contracting authorities may award public contracts by a negotiated procedure without prior publication. (2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:- (a)where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests;
