BHSCT are employing Regulation 32 (2) (b) of the Public Contracts Regulation 2015 (as amended) which provides a derogation from the obligation to competitively tender for a contract for goods and services over the EU threshold where the works, supplies or services can be supplied only by a particular economic operator for either of the following reasons (ii) Competition is absent for technical reasons No other reasonable alternative or substitute exists for this procurement The National Physical Laboratory (NPL) is a Public Corporation and the UK's National Metrology Institute (NMI), developing and maintaining the national primary measurement standards across the UK the absence of competition is not a result of artificial narrowing of the parameters of the procurement.
