## Summary

The Ministry of Defence (MOD) has awarded a contract for In Service Support for the Provision of Spares, inclusive of Repair and Post Design Services (PDS), to Elmer and AD120 Avionic Communications Equipment. This contract, valued at £4.7m, covers an initial three-year term with an option to extend for an additional two years in one-year increments. The procurement falls under the services category, specifically targeting maintenance services of radio-communications equipment (CPV code 50333000). The contract was awarded to Marlborough Communications Limited without publication of a contract notice due to a failed competitive procurement process. The procurement method utilised was a single-source negotiation as permitted under Regulation 16(1)(f) of the Defence and Security Public Contract Regulations (DSPCR) 2011. The contract was signed on 16th December 2024, with services to be delivered within the UK.

This tender presents significant opportunities for companies specialising in avionic communication repair and maintenance services, particularly those with capabilities in providing spares and support for Elmer and AD120 equipment. Businesses that can deliver reliable and high-quality repair services and have the flexibility to adapt to post-design modifications will be well-suited to compete for similar future contracts. This procurement is particularly advantageous for those looking to establish or strengthen relationships with the MOD and secure long-term contracts that include options for extension and potential provision of new assemblies.

### Procurement Information

The Air Commodities Delivery Team (ACDT) within Defence Equipment & Support (DE&S), part of the UK Ministry of Defence, ("the Authority") intends to place a Single Source Contract with Marlborough Communications Limited for the In Service Support for the Provision of Repair and Post Design Services (PDS) to Elmer Radio and AD120 Avionic Communication Equipment for an initial 3 year term with an Option to extend by a further 24 months in 12 month increments. The value for the contract is estimated at PS4.7m over the maximum 5 years. Due to the Authority receiving only two PQQ responses with only one response meeting the minimum criteria the Authority has a failed competition and competitive procurement under the accelerated restricted procedure is no longer possible. Therefore a Single Source procurement in line with Regulation 16(1)(f) of the Defence and Security Public Contract Regulations (DSPCR) 2011 is the only feasible option to meet the requirement to provide continued support to the Elmer Radio and AD120 Avionic Comms equipment.
