There is currently no market competition or reasonable alternative for these kits. MRC Holland are the sole supplier of kits worldwide, there is no alternative supplier. BHSCT will continue to review the market for these kits once competition has been identified the Team will seek to tender. BHSCT are relying on Regulation 32(2)(b) of the public contracts regulations which provides a derogation from the obligation to competitively tender for a contract for goods or services over the EU Threshold where the works or supplies or services can be supplied only by a particular economic operator as competition is absent for technical reasons - no other viable reasonable alternative exists for this procurement, MRC are sole suppliers of the dosage analysis Multiplex Ligation Amplification (MLPA) commercial kits. These kits are essential for patient care and patient delivery. The absence of competition is not the result of an artifical narrowing down of the parameters of the procurement.
