## Summary

Jisc Services Limited has successfully executed a framework agreement with Oracle Corporation UK Limited, focusing on the procurement of Oracle Java SE Universal Subscriptions. This process concerns educational organisations across the UK, including higher and further education institutions, consortiums, and various educational bodies, and is classified within the "Programming languages and tools" industry category. The award phase of the procurement was completed, with key agreements signed on 28 May 2025 and 31 January 2025. The procurement method employed was a limited procedure, justified by technical reasons that necessitated negotiation without previous publication. Financially, the contract holds a value of £9,863,838.77.

This procurement initiative, led by Jisc, presents substantial opportunities for educational institutions using Oracle Java SE, particularly in terms of consolidating costs and enhancing operational efficiency. The waiver of historic subscription fees offers a financial reprieve for institutions previously utilising Oracle Java products. Businesses possessing expertise in programming languages and software solutions might find avenues for collaboration or consultancy, especially in tailoring the subscription services to fit specific institutional needs. The framework agreement reinforces Oracle Corporation's pivotal role due to their exclusive technical rights, making this a niche opportunity for businesses aligned with Oracle's product offerings.

## Notice

### Lot Information

Lot 1

Jisc Services Limited has entered into a framework agreement with Oracle Corporation UK Limited for the ordering of Oracle Java SE Universal Subscription for any participating institutions listed in Section VI. The agreement includes the waiver of historic fees due for any institutions who have used Oracle Java since 2023.

### Procurement Information

Institutions that use Oracle Java SE are required to purchase subscriptions. Following consultations with the HE and FE sectors, institutions have instructed Jisc to purchase Oracle Java SE Universal Subscriptions (collectively) based on the applicable procurement relationship. In this case it is not possible to competitively tender this requirement on behalf of our members and would not be in the public interest, both in terms of cost associated and the significant operational risks associated with changing suppliers. Oracle Corporation has sole technical rights to their products, and the waiver of historic fees as mentioned in the description cannot be provided by any other than Oracle. No alternative route is possible other than direct negotiation with and award to Oracle itself. Jisc therefore relies on Regulation 32.2b (ii) of PCR2015, because the use of Oracle Java is necessary and there is no competition for technical reasons. There is no reasonable alternative or substitute approach available at this time. Jisc Services Limited observed, without challenge, a 30 day standstill period.
