## Summary

The Royal United Hospitals Bath NHS Foundation Trust (RUH) has awarded a contract for the supply and installation of a community-funded solar panel system at their facility, located in Bath (region UKK1), under the industry category "Solar energy" (CPV: 09330000). The contract, titled "Contract for the supply of a solar installation at the RUH," was awarded on 19th February 2025. RUH undertook this project as a procurement process classified under "goods" with a limited procurement method, specifically without prior publication of a call for competition. The contract will remain in place for 25 years, facilitated by a direct award procedure due to its outside scope of application of the directive, with Bath and West Community Solar 3 Limited as the supplier. This decision was driven by both environmental and strategic social value motives, seeking to fulfil sustainability targets and community engagement through renewable energy solutions.

This tender presents significant opportunities for businesses involved in the renewable energy sector, especially those with expertise in community-funded projects. Companies that specialise in solar energy installations, community benefit schemes, and sustainable energy solutions are particularly well-suited for similar future contracts. The initiative by RUH to involve local communities through partnership projects offers SMEs a chance to participate in long-term, impactful projects that not only contribute to environmental sustainability but also foster community development and support. By engaging in such tenders, businesses can potentially grow their market presence, form strategic partnerships, and align with government entities aiming to meet their carbon neutrality goals while supporting local economies.

### Procurement Information

Royal United Hospitals Bath NHS Foundation Trust (referred to as "RUH) intends to award a contract under Regulation 32(2)(b)(ii) to Bath and West Community Solar 3 Limited, (referred to as Bath and West) for the supply and installation of a community funded, solar panel system, for a period of twenty-five (25) years.

This contract will involve the RUH granting a lease to Bath and West to install solar panel technology in available roof space above the hospital estate. In exchange, Bath and West will provide a community funded solar installation, raised via their community benefit society. RUH will be enabled to purchase electricity generated at a discounted rate to that currently paid from a grid supply. It is estimated that the Trust will use 100% of the electricity generated by the solar installation.

Bath and West is a not-for-profit organisation, based in the Bath area, with key locally based funding streams and evidence of other community funded projects that benefit the local area. They develop renewable energy projects for community ownership and generate benefits through the use of community funds.

In awarding to Bath and West, RUH is satisfying key strategic targets for the ongoing delivery of sustainable and social value projects.

1) The RUH does not have capital funding available to procure solar panels, Therefore, awarding a contract to this organisation will enable the Trust to modernise its energy provision without having to provide capital outlay.
2) The installation will utilise the currently unused roof space and will not impact on the surrounding landscape of the Trust.
3) RUH has key social value and sustainability targets, which include increasing ties with the local community through partnership projects and achieving carbon nett zero. Bath and West can demonstrate other renewable energy projects within the local area, providing education and information regarding the benefits of renewable energy and providing a bridge between the Trust and local community support and development. Awarding a contract to this company will demonstrate improved delivery of social value targets and improved sustainability including the delivery of Carbon net zero aspirations.

RUH has reviewed the factors described in the proposal and considered Bath and West's niche position in the local area and have assessed that awarding this contract enables the Trust to satisfy an optimal combination of commercial, sustainability and social value targets.

RUH will observe a 10-day standstill from the date of this notice before entering into a contract with Bath and West Bath and West Community Solar 3 Limited.
