### Procurement Information

The ICB are relying on the urgency provision in paragraph 13 of Schedule 5 to the Procurement Act 2023 permitting a direct award on the basis that the services to be supplied under the public contract are strictly necessary for reasons of extreme and unavoidable urgency, and as a result the public contract cannot be awarded on the basis of a competitive tendering procedure. A procurement process has been undertaken and the award decision has been challenged. This has prevented final award and therefore requires a short term contract with the existing provider to ensure that there is a continuation of vital services for primary care settings (GP's and Pharmacy) whilst this challenge is resolved. The Authority believes competition is absent for the technical reasons outlined above.
