        "description": "North Yorkshire Council (\"the Council\") is seeking Providers to deliver high-quality Live in Care Services through the Procurement of a Framework Agreement. This framework agreement supports the Council's Health and Adult Services plan to help people live longer healthier and more independent lives in association with one of the four ambitions: My Home, My Community, My Choice. These ambitions are underpinned by statements about what they will mean to people. This framework agreement will support the Council to develop and support a diverse care market to provide safe, high quality and value for money care and support to the people of North Yorkshire, as defined within the North Yorkshire Market Position Statement and Strategic Development Plan.                 "description": "Referrals may be made to the Service by telephone, writing or via the Council's electronic brokerage system. The Provider shall nominate Persons to accept referrals and shall inform the Council of their names, email addresses and telephone numbers, and update as necessary. The Council will provide information about the Person's care and support requirements as part of the referral. The Council will ensure that the Person's home is suitable for a Live in Care Worker to reside and specify any information or risks that may affect the Live in Care Worker. This information may include but not be limited to: * Substance abuse concerns * Pets in the Person's home * Whether the Person smokes * Risks in relation to the environment * Any other Person living or has residence at the property * Location of the property and access, incl. local transport and facilities * Internet access Framework providers will be required to submit responses to referrals which shall be evaluated based on defined criteria. The criteria may be subject to change throughout the term and in association with the individual Service requirements. The criteria will include but not be limited to: * Available capacity to provide the service requested, and evidence of Service continuity plans; * Ability to provide a consistent team of appropriately trained and experienced Live in Care Workers to provide the service requested, with minimum changed in Personnel; * Ability to commence the service in accordance with desired start date. Where a number of providers submit responses to referrals and have confirmed that they can fully meet the above defined criteria, the decision to award shall be made on best value and will include an element of user choice. Any additional award criteria will be set out in the referral form. The Provider will seek to appropriately match the Live in Care Worker with the Person based on the support needs and preferences. The Provider shall deliver the Services for the Person (s) named as set out on the Individual Service Contract (ISC) from the start date, until the Services are cancelled, suspended or varied in accordance with the Framework. For the avoidance of doubt, the Council does not guarantee any volume of work under this Framework. The Provider shall ensure that they have the capacity and capability to deliver Services 365 days per year (366 days in a leap year). The Provider must be able to demonstrate flexibility in deploying Live in Care Workers in response to meet their capacity requirements. Where ISCs are awarded, the Provider must conduct regular reviews of Provider Personnel levels and resources especially at times of increased demand. The Provider must be able to receive and respond to referrals between 8:00am and 20:00pm 7 days a week. Subject to the receipt of appropriate referral information, the Provider will respond within 48 hours. New Services should be available to commence within 7 calendar days or as agreed between the Council and the Provider. Where the referral relates to a Person who has or is going to be discharged from hospital the Provider may be required to commence the Service within 48 hours, or within an timescale agreed between the Council and the Provider. For the avoidance of doubt, the Council does not guarantee any volume of work under this Framework. The services to be procured are defined as a light touch contract as set out in Section 9 of the Procurement Act. As such, the Council will utilise the flexibility provided by Section 45 Frameworks, clause (9), in the operation of the framework.",

Whilst the Council may not be able to define every potential modification which may result in a variation to the Framework Agreement, the following provides a list of potential anticipated modifications: * System, process or policy changes * Pricing revisions, which may include but not be limited to Actual Cost of Care Exercises * Operational ways of working or delegated responsibilities (for example; introduction of contract tolerances and/or Trusted assessment or review processes) * Health integration or commissioning opportunities * Adaptation to the service specification and staff training requirements (for example, in relation to the development of the North Yorkshire Specialist Service Model) * Estimated work volumes * Potential of insufficient provider capacity post-award Every effort will be made to award Individual Service Contracts (ISCs) as per the process set out in the tender documents however, there may be times where urgency or other unanticipated factors require a Provider to be placed with an individual outside of the described process."
